Privacy and Return Policy

1. Definitions

1.1 In this Privacy Policy, the following terms are used:

1.1.1 "Website Administration" – authorized employees responsible for managing the website of the online store convulsive, who organize and/or process personal data, and determine the purposes of personal data processing, the categories of personal data to be processed, and the actions (operations) performed with personal data.

1.1.2 "Personal Data" – any information relating to a directly or indirectly identified, or identifiable natural person (data subject).

1.1.3 "Processing of Personal Data" – any action (operation) or set of actions (operations) performed with personal data, whether or not using automated tools, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), retrieval, use, transfer (dissemination, provision, access), anonymization, blocking, deletion, destruction of personal data.

1.1.4 "Confidentiality of Personal Data" – a requirement for the Operator or any other person who has access to personal data to prevent its dissemination without the consent of the data subject or the presence of another legal basis.

1.1.5 "Website of the convulsive online store" – a set of interconnected web pages located on the internet at the unique address (URL): https://convulsivx.store/ and its subdomains.

1.1.6 "Subdomains" – pages or sets of pages located on third-level domains owned by the convulsive online store website, as well as other temporary pages that contain contact information of the Administration.

1.1.7 "Cookies" – a small piece of data sent by a web server and stored on the user's computer, which the web client or browser sends back to the web server each time it attempts to open a page on the corresponding website.

1.1.8 "IP Address" – a unique network address of a node in a computer network through which the User accesses the online store.

1.1.9 "Product" – the product that the User orders on the website and pays for via payment systems.

2. General Principles

2.1 Using the website of the convulsive online store by the User means the User's consent to this Privacy Policy and the terms of personal data processing.

2.2 If the User does not agree with the terms of the Privacy Policy, the User must stop using the website of the convulsive online store.

2.3 This Privacy Policy applies to the website of the convulsive online store. The online store does not control and is not responsible for third-party websites that the User may visit through links available on the website.

2.4 The Administration does not verify the accuracy of the personal data provided by the User.

3. Subject of the Privacy Policy

3.1 This Privacy Policy establishes the obligations of the Administration to not disclose and ensure the protection of the confidentiality of personal data that the User provides upon request from the Administration during registration on the website, subscription to the information email newsletter, or order placement.

3.2 Personal data that may be processed under this Privacy Policy are provided by the User by filling out forms on the website and include the following information:

• 3.2.1 User's first name, last name, patronymic.
• 3.2.2 User's contact phone number.
• 3.2.3 User's email address.
• 3.2.4 User's place of residence (if required).
• 3.2.5 Delivery address for the Product (if required).
• 3.2.6 Photograph (if required).

3.3 The online store protects data that is automatically transmitted when visiting pages: IP address, information from cookies, browser information, access time, referer (address of the previous page).

• 3.3.1 Disabling cookies may prevent access to parts of the site that require authorization.
• 3.3.2 The online store collects statistics about the IP addresses of its visitors. This information is used to prevent, detect, and resolve technical issues.
• 3.4. Any other personal information not specified above (browsing history, browsers, operating systems, etc.) is securely stored and not disclosed, except in cases outlined in paragraphs 5.2 and 5.3 of this Privacy Policy.

4.1. The Administration may use the User's personal data for the following purposes:

• 4.1.1. Identifying the User registered on the website of the convulsive online store for further authorization, order processing, and other actions.
• 4.1.2. Providing the User with access to the website's personal data.
• 4.1.3. Establishing communication with the User, including sending notifications, requests regarding the use of the website, providing services, and processing inquiries and requests from the User.
• 4.1.4. Determining the location of the User to ensure security and prevent fraud.
• 4.1.5. Verifying the accuracy and completeness of the personal data provided by the User.
• 4.1.6. Creating a user account for using certain parts of the website if the User has consented to creating an account.
• 4.1.7. Notifying the User via email.
• 4.1.8. Providing the User with effective technical support in case of problems related to the use of the website.
• 4.1.9. Sending the User special offers, pricing information, newsletters, and other information on behalf of the website with the User's consent.
• 4.1.10. Conducting advertising activities with the User's consent.

5.1. The processing of personal data is carried out by the Administration in accordance with applicable laws and in an automated or manual manner without time limits.

5.2. The User agrees that the Administration may transfer personal data to third parties, such as courier services, postal organizations (including electronic mail), and telecommunications operators, solely for the purpose of fulfilling the User's order placed on the website, including the delivery of the Product, documentation, or email notifications.

5.3. The User's personal data may be transferred to authorized government authorities of Ukraine only in accordance with the laws and procedures established by Ukrainian legislation.

5.4. In case of loss or disclosure of personal data, the Administration has the right not to inform the User about the loss or disclosure of personal data.

5.5. The Administration takes the necessary organizational and technical measures to protect the User's personal information from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, and other illegal actions by third parties.

5.6. The Administration, together with the User, takes all necessary measures to prevent damage or other negative consequences caused by the loss or disclosure of the User's personal data.

• 6.1. The User has the right to:
• 6.1.1. Make a free decision about providing personal data necessary to use the website and give consent to its processing.
• 6.1.2. Update or supplement the provided personal data if such information changes.
• 6.1.3. The User has the right to request from the Administration information regarding the processing of their personal data, unless restricted by applicable federal laws. The User has the right to demand the correction, blocking, or deletion of personal data if the personal data is incomplete, outdated, inaccurate, unlawfully obtained, or unnecessary for the stated processing purpose, and also take the necessary legal measures to protect their rights.
• 6.2. The Administration is obligated to:
• 6.2.1. Use the received information exclusively for the purposes outlined in paragraph 4 of this Privacy Policy.
• 6.2.2. Ensure the confidentiality of the information, not disclose it without the User's prior written consent, and not sell, exchange, publish, or disclose personal data in any other possible way, except as specified in paragraphs 5.2 and 5.3 of this Privacy Policy.
• 6.2.3. Take preventive measures to protect the confidentiality of personal data in accordance with the general practices for safeguarding such information in current business transactions.
• 6.2.4. Block the personal data of the relevant User upon request from the User or their legal representative or an authorized data protection authority during the verification process if false personal data or unlawful actions are detected.
• 7. Responsibility of the Parties
• 7.1. The Administration, failing to fulfill its obligations, is responsible for damages incurred by the User due to unlawful use of personal data, in accordance with the laws of Ukraine, except in cases specified in paragraphs 5.2, 5.3, and 7.2 of this Privacy Policy.
• 7.2. In case of loss or disclosure of Confidential Information, the Administration is not liable if such information:
• 7.2.1. Became public knowledge before its loss or disclosure.
• 7.2.2. Was obtained from a third party before it was received by the Administration.
• 7.2.3. Was disclosed with the User's consent.
• 7.3. The User is fully responsible for complying with the laws of Ukraine, including those on advertising, copyright protection, trademark protection, and intellectual property rights, including full responsibility for the content and form of materials.
• 7.4. The User acknowledges that the person providing information on the website is responsible for that information, including but not limited to data files, texts, etc.
• 7.5. The User agrees that the information provided to them as part of the website may be subject to intellectual property rights owned by others, including other Users, partners, or advertisers. The User is not allowed to alter, lease, sell, distribute, or create derivative works based on such content without explicit permission from the content owner.
• 8. Dispute Resolution
• 8.1. Before going to court, the User should submit a written complaint (electronic or paper) to the Administration.
• 8.2. The Administration will respond within 30 calendar days.
• 8.3. If no agreement is reached, the dispute will be resolved through the Arbitration Court in Kyiv.
• 9. Additional Terms
• 9.1. The Administration may amend this Privacy Policy without obtaining the User’s consent.
• 9.2. The new Privacy Policy will be effective once published on the website of the convulsive online store unless otherwise specified.

• Returns
  • You can return the full order amount within 48 hours of purchase (or charge of the item). This return will be considered as a refusal to wait for the product.
  • The item must be returned in its original packaging.
  • All returns are inspected at the post office. If the item is found to be unsuitable for resale, we reserve the right to refuse the return of funds.
  • Returns are processed within up to 14 business days.
• Defective Product Returns
  • If you find a defect, you must provide photo or video proof of the defect on the product itself.
  • Returns for defects are only possible within 30 minutes after receiving the item, as the condition of the product may change after that time.
  • If the defect is confirmed, we will send you a new, defect-free item. Refunds are not available in this case.
  • To return the item, please use the "Legke Povernennya" (Easy Return) feature in the "Nova Poshta" app. After the seller receives the item, you can contact us via Instagram or the cash-on-delivery chat.

Вы можете оплатить заказ онлайн, используя банковскую карту Visa или MasterCard. Процесс оплаты выглядит следующим образом:

• При оформлении заказа выберите способ оплаты.
• В разделе «Оплата» укажите «Visa/MasterCard».

Важно: мы не предоставляем возможность оплаты после получения товара.

Доставка в отделения «Новой Почты» по Украине

Доставка через «Новую Почту» позволяет получать товары даже в самых отдалённых регионах Украины:

• Срок доставки составляет 2–5 дней.
• Обработка заказа может занять 10–25 дней.
• Минимальная стоимость доставки до отделения — от 70 грн.

Оплата доставки включается в стоимость заказа при его оформлении.

Международная доставка

Для доставки за границу используются услуги «Укрпочты» и «Новой Почты»:

• Стоимость доставки указывается и оплачивается при оформлении заказа.
• В отдельных случаях оплата стоимости товара может быть проведена отдельно — уточняйте при заказе.
• Обработка международного заказа может занять от 10 до 25 дней.

Ваши права на возврат и обмен товаров в соответствии с законодательством Украины:

Мы предоставляем возможность обменять товар на аналогичный из другой партии или выбрать другой товар на ту же сумму.

Возврат товаров с дефектом:

• Дефект невозможно устранить.
• Устранение дефекта занимает более двух недель.
• Дефект настолько изменяет характеристики товара, что он больше не соответствует описанию.

После подтверждения возврата вы можете выбрать один из вариантов компенсации:

• Обменять товар на аналогичный.
• Получить другой товар на сумму, равную стоимости дефектного.
• Оформить возврат денег за товар.

Возврат товаров надлежащего качества:

Вы можете вернуть товар в течение 14 дней с момента покупки, если он вам не подошёл по причинам (цвет, размер, фасон).

• Сохранить полную комплектацию товара.
• Убедиться, что упаковка, пломбы и ярлыки не повреждены.
• Вернуть товар в том же виде, в котором он был приобретён.
• Исключить использование товара до возврата.
